Getting an Indian Land Divorce
Prior to moving forward with a divorce, at Robert J. Reeves, P.C., we recommend that you and your spouse try to reconcile. Even if you believe that the marriage will fail and want to initiate divorce proceedings, you can still work towards reconciliation. Seeking an Indian Land divorce will not prevent that.
Now, if you absolutely cannot reconcile, we will be here for you. Instead of looking to scorch the earth and wage war in family court, our lawyers prefer to handle your divorce like grown-ups. We refuse to waste your time and money on pointless fighting with your spouse and your spouse’s lawyer. Thus, instead of adding fuel to the fire, we prefer to get you from point A to point B as quickly and cost effectively as possible for you.
Grounds for Divorce
There are five separate grounds for an Indian Land divorce. They are:
- Living separate and apart and without cohabitation for one year
- Adultery
- Desertion
- Physical cruelty
- Habitual drunkenness and drug abuse
While the first ground listed above does not require fault, the other four do. Any of the five grounds above will get you a divorce. The difference is that the fault based grounds can get you divorced immediately without waiting for a year to lapse since separating. Also, adultery can prevent the at fault party from receiving alimony. And understand that there are defenses to an at fault ground.
Because the ground that you choose to pursue is important, our attorneys will look at your case and advise you about your options.
An Indian Land divorce is not easy. There will be hard moments. It may even seem like a never-ending ordeal. However, our attorneys will do everything in their power to guide you through this time of your life. We will be here for you throughout your divorce and everything that comes with it.
